A first offence in Brisbane
In this Brisbane low range drink driving case study, Joshua Boorman appeared at Brisbane Magistrates Court on a low range drink driving offence with a reading of 0.071. He is careful to say that no driving matter is trivial, but describes this one as relatively minor. It was the client’s first offence, he had a very good traffic record with only a handful of minor entries, and nothing aggravated the matter.
A night in Fortitude Valley
The client drove to Fortitude Valley for a night out. He had had a medical procedure earlier that day (the captions suggest under a general anaesthetic), so he intended to have only one or two drinks all night. He admits he got carried away socialising with friends and had about five drinks over about five hours, which were more than standard drinks. He then made the decision to drive home.
How police became involved
He had pulled over to the side of the road to wait for a friend who was inside a nightclub. An unmarked police car pulled up and beeped at him. He did not realise it was police and stayed where he was. When they flashed their lights, he drove up and pulled over in a more appropriate spot.
He was breath tested, and a reading of 0.071 was recorded at the station. Joshua describes the objective seriousness as relatively low.
Why a conviction mattered
The client works as an estimator in the ordering team of a large construction company. Losing his licence would be inconvenient for work, but would not cost him his job.
He is also heavily involved in the dance community and competes for Australia, including overseas. Joshua says it was very important to put that before the court in trying to avoid a conviction being recorded. The client also completed the Traffic Offenders Program, which Joshua says showed insight and gave the court some assurance he would not repeat the mistake.
The outcome
Joshua asked for the minimum one-month disqualification, a small fine and no conviction, and the court agreed:
- a 1-month disqualification from the day of court;
- a $350 fine; and
- no conviction recorded.
Joshua says the client, who had never been in trouble before and was very nervous, was very relieved to have the matter finished.
What this Brisbane low range drink driving case study shows
Even at a low reading, the decision whether to record a conviction depends on the person’s circumstances. Here, his international dance commitments were a key part of the case, along with his clean record and the traffic program. Every case is different, and outcomes depend on the facts.
Key general information (QLD)
General information only, not legal advice, as at October 2026. Every case turns on its own facts.
- Drink driving offences: In Queensland, drink driving offences are set out in the Transport Operations (Road Use Management) Act 1995 (Qld).
- The broad penalty picture: TMR describes a 24-hour suspension where the reading is under 0.10, and an immediate suspension, lasting until the charge is dealt with, for mid and high range charges and some other situations.
- What happens to a Queensland licence before court: For a low range charge (over 0.0 but under 0.10), the licence is generally not suspended immediately until court, unless an earlier drink driving charge is still pending or certain other conditions apply.
- Sentencing and convictions: Alongside the disqualification set under the road transport laws, the general sentencing law in Queensland is the Penalties and Sentences Act 1992 (Qld).
- The court process: Drink and drug driving charges in Queensland are dealt with in the Magistrates Court.
