Summary

Joshua Boorman explains a next-morning low range (0.081) drink driving charge at Birdsville after the Big Red Bash. The matter was transferred from Mount Isa to Brisbane Magistrates Court at Roma Street, where the 64-year-old client with no history received the 1-month minimum disqualification, a $400 fine and no conviction.

Key takeaways

  • Drinking the night before kept the client over the limit (0.081) the next morning.
  • The matter was transferred from Mount Isa to Brisbane so the NSW-based client could attend in person.
  • A traffic offender program, apology, RSL and fire brigade references and community certificates made up the defence bundle.
  • At 64 with no traffic or criminal history, the offence was shown to be out of character.
  • The court imposed the 1-month minimum disqualification and a $400 fine, and recorded no conviction.

An unusual Brisbane courthouse

The matter in this Brisbane next day drink driving case study was finalised at the Brisbane Magistrates Court — not the usual George Street building, but the Roma Street court. As Joshua Boorman explains, Roma Street is generally used for people who have been held overnight in the watch house and brought before the court in the morning, and it is usually less busy than George Street.

What happened

Our client lives in New South Wales, near the Victorian border. He was travelling through regional Queensland with his wife and had been at the Big Red Bash, a country and western music festival. He had a great time and had a few too many drinks the night before.

The next morning he got up in his caravan and hit the road, thinking he was fine to drive. Out at Birdsville he was pulled over for not keeping left — a fairly minor traffic infringement — and breath tested. Even though it was the next morning, he was still over the limit at 0.081, in the low range.

Getting the matter transferred

The charge was listed at Mount Isa Magistrates Court, but by then our client had gone home to NSW. After he engaged us, we contacted the Mount Isa court, indicated it would be a guilty plea, and had the matter transferred to Brisbane, which was far easier for him to reach by flying up.

Matters transferred to Brisbane would normally go to George Street, but because this one had come from another court and there was a warrant on file — which was dealt with on the day — it was listed at Roma Street.

Brisbane next day drink driving case study: how Joshua Boorman prepared the case

Our client did everything we asked of him:

  • completed a traffic offender program;
  • wrote a letter of apology;
  • obtained references from people at his local RSL and local fire brigade, where he is heavily involved; and
  • provided certificates showing that involvement in his community.

Together that made a neat bundle of defence material showing he was remorseful and had taken steps to re-educate himself about driver safety.

His personal circumstances

He was 64 years old and owns a trucking and transport business, so driving is essential to his work. He had no prior traffic or criminal history at all. As Joshua told the court, that showed he had behaved in an exemplary manner his entire life, and this next-day offence was extremely out of character.

The outcome

We asked the court to consider the absolute minimum period of disqualification, one month, and the magistrate agreed. The result:

  • the one-month minimum disqualification;
  • a $400 fine; and
  • no conviction recorded, because he had shown the offence was out of character and an honest mistake by someone who had spent his whole life doing the right thing.

That was exactly the result he had hoped for, because he drives for work. He had driven to Melbourne Airport and flown up to attend court in person, and left very happy.

What this case shows

Alcohol from the night before can keep you over the limit the next morning. For a first offender with a clean record, a well-prepared bundle — a traffic offender program, an apology, references and evidence of community involvement — can support a minimum disqualification and a no-conviction outcome. A matter can also be transferred to a more practical court. Every case is different.

Key general information (QLD)

General information only, not legal advice, as at October 2026. Every case turns on its own facts.

  • Drink driving offences: In Queensland, drink driving offences are set out in the Transport Operations (Road Use Management) Act 1995 (Qld).
  • The broad penalty picture: TMR describes a 24-hour suspension where the reading is under 0.10, and an immediate suspension, lasting until the charge is dealt with, for mid and high range charges and some other situations.
  • Work licences: Queensland has a “restricted licence”, commonly called a work licence, under section 87 of the Transport Operations (Road Use Management) Act. TMR’s restricted licence page explains that the application is made to the magistrate after a finding of guilt and before the disqualification is imposed.
  • Sentencing and convictions: Alongside the disqualification set under the road transport laws, the general sentencing law in Queensland is the Penalties and Sentences Act 1992 (Qld).
  • The court process: Drink and drug driving charges in Queensland are dealt with in the Magistrates Court.

Frequently asked questions

What was the penalty for this low range drink driving charge?

The magistrate imposed the one-month minimum disqualification and a $400 fine, and did not record a conviction.

Can you be charged with drink driving the morning after drinking?

Yes. In this case the client drank the night before, drove the next morning thinking he was fine, and still recorded 0.081.

Can a Queensland drink driving matter be moved to another court?

In this case the matter was listed at Mount Isa, and Boorman Lawyers arranged for it to be transferred to Brisbane after indicating a guilty plea, because it was easier for the client to fly in.

Why was no conviction recorded?

The client was 64 with no prior traffic or criminal history, and the court accepted the offence was out of character and an honest mistake.

What are the alcohol limits in Queensland?

As at October 2026, TMR describes four limits: a no-alcohol limit for learner, provisional, probationary and restricted licence holders and drivers of certain vehicles; the general limit of 0.05; the middle limit of 0.10; and the high limit of 0.15.

What is a work licence in Queensland?

It is a restricted licence ordered by the court under section 87 of the Transport Operations (Road Use Management) Act 1995. TMR explains it must be applied for before the magistrate imposes the disqualification, and lists eligibility criteria and exclusions, such as a reading of 0.15 or more or a drink or drug driving conviction in the previous five years.

Good day. It's Josh here from Boorman Lawyers. I'm just outside Brisbane Magistrates Court. Not the usual Brisbane Magistrates Court, but this is the Roma Street, Brisbane Magistrates Court just behind me. Um, so this court's generally utilised for um, uh, people who've been locked up overnight, who are in the watch house putting before the court in the morning. It's usually not quite as busy as the George Street Magistrates Court. Uh the reason why I'm here today is that uh our client had a low range drink driving offence out in Birdsville and uh the matter was a few weeks ago put at Mount Isa Magistrates Court.

Um our client uh lives in New South Wales down near the Victorian border. So at the time of uh the offence, he was travelling throughout regional Queensland. He had attended the Big Red Bash, which is a um country and western uh music festival. Um went there with his wife. Um and uh had had had a great time. Had um few too many drinks the night before. The next morning he got up. He was in his caravan and uh with his wife and uh hit the road.

Think he was fine to drive. Um he was pulled over for not keeping left and uh quite a minor traffic infringement, but they did breath test him and um and found that he was still quite over the limit at 0.081. So um even though it was the next day offence, the reading was still uh well over the blood alcohol limit in the low range. 0.081. Um, so the matter was put before Mount Isa uh, Magistrates Court, but by by the time the matter went to appear at Mount Isa Court, our client had returned back home to New South Wales.

So, he engaged us. We contacted uh, Mount Isa Magistrates Court. We indicated it was going to be a plea of guilty and we wanted to get the matter transferred um, to Brisbane. though it was uh more easily accessible for him to fly up from New South Wales and attend uh the Brisbane Magistrates Court instead of the Mount Isa Magistrates Court. Uh so we've just dealt with the matter today and usual usually matters which go to Brisbane Magistrates Court uh will go to the George Street Magistrates Court but because this had travelled from another court um and that there was a warrant to lie on file which we got rid of today uh it was put at the Roma Street Magistrates Court.

So anyway, that's how it ended up here at this uh more unusual magistrates court location in the the Brisbane CBD. Um, in any event, uh, our client did all the right things that we asked of him. He did a traffic offenders program. He got a letter of apology together. He lives in quite a rural um, small populated community um, in New South Wales on the Victorian border where he's involved in the local RSL in the local fire brigade. We got references from people from both of those organisations um and also certificates to show that he's very heavily involved in um those community organisations. as mentioned, he did the traffic offenders program and uh so we had a nice little neat bundle of um defence material to tender to the court to show that our client was um remorseful, taking steps to address any um uh well re-educate himself on driver safety.

Now, he was 64 years of age. He owns a uh a trucking transport business. So driving is pretty essential to his ability to drive um uh to to work. Sorry. Um but for someone who's 64 with no prior traffic or criminal history before the court, it it really did show that he has um behaved in an exemplary manner in for his entire life and that this next day type of offence was extremely out of character for him. Um we were asking court to consider uh the absolute minimum period of 1 month and that was acceded to by the magistrate.

Um he was given a $400 fine and no conviction was recorded because he's really proven that this was out of character and um that a conviction really um uh for this type of matter and the way it came out shouldn't be put there as a deterrent because um it it was just a real honest mistake on his behalf and he's u spent his whole life behaving correctly. So, he didn't record a conviction, $400 fine, minimum one month, which is really what our client was hoping to get because um he does drive for work.

So, um very very happy um client. He's flown up today um from Melbourne. Um he had to drive to Melbourne airport from where he lives, fly up from Melbourne. He's here in person today. We got a really good outcome. can enjoy the rest of the day in sunny Brisbane before flying back. And that's our matter that we had here at the Brisbane Magistrates Court today, the Roma Street location. Thanks for tuning in.
