Summary

Josh Boorman explains Queensland's high range drink driving category, which covers readings of 0.150 or more. He sets out the penalties he describes for first, second and third offences, explains why there is no work licence at that level, and outlines when imprisonment becomes mandatory.

Key takeaways

  • High range in Queensland covers readings of 0.150 or more.
  • Josh says a first offence carries a 6-month minimum disqualification and up to 9 months in prison.
  • No work licence is available for a reading of 0.150 or more.
  • Josh says a second offence within 5 years carries a 12-month minimum, and a third a 2-year minimum.
  • Three high range offences in 5 years mean mandatory imprisonment of some kind, Josh explains.

What counts as high range: Queensland high range drink driving penalties

In this Queensland high range drink driving penalties video, Josh Boorman explains the penalties and the offence itself, which is also described as driving under the influence of liquor or drugs, or UIL. He explains that the category covers any reading of 0.150 or higher.

Josh describes high range as the most serious category of drink driving in Queensland. He stresses that every matter is dealt with case by case. One person might be just on the cusp of 0.150 at a random breath test; another might be close to 0.3 and extremely intoxicated, with children in the car or involved in an accident. The court takes the full range of facts and circumstances into account.

A first offence

Josh explains that a first offence means no prior offences of a similar nature in the last five years. He says the maximum penalty is nine months in prison, but generally a person will not receive jail time for a first high range offence unless there is something significantly aggravating about it. Jail is a sentence of last resort, but it is at the court’s disposal.

According to Josh, the maximum financial penalty is 28 penalty units. The court must disqualify the licence for a minimum of six months and cannot give less, but it can increase the period at its discretion, up to a lifetime ban or indefinite disqualification. He notes that this is rarely seen for a first-time high range offender.

No work licence

Josh explains that for any high range offence, whether a first, second, third or later offence, a person with a reading of 0.150 or more is ineligible for a work licence. He describes this as black and white: there is no persuading the court, because the law says that a person cannot apply above that reading.

A second offence

For a second high range offence within five years, meaning there is a prior drink driving matter in the last five years, Josh says the maximum penalty is 18 months in prison and 60 penalty units. The minimum disqualification is 12 months, and the court cannot go lower, but it can disqualify anywhere from one year up to an indefinite disqualification.

A third offence and mandatory imprisonment

For a third offence within five years, where there are two prior drink driving offences in the last five years, Josh says the maximum is 18 months’ imprisonment and 60 penalty units, with a minimum of two years’ disqualification. The court can go higher, but two years is the absolute minimum.

He highlights an important rule for very high risk repeat offenders. Where a person has three high range offences within five years, he explains, the law says the court must impose a term of imprisonment. That does not always mean full-time custody in jail: it can be a suspended sentence, or a sentence with immediate parole on the day of court. But the court must hand down a period of imprisonment of some sort, so the stakes are very high.

Key points from this Queensland high range drink driving penalties video

Josh’s message is that the stakes rise sharply once a reading reaches the high range category: a longer minimum disqualification, no work licence, and much heavier penalties for repeat offending within five years.

Key general information (QLD)

General information only, not legal advice, as at October 2026. Every case turns on its own facts.

  • What the official sources say: For a first offence at 0.15 or more, TMR lists a minimum disqualification of 6 months and up to 9 months’ imprisonment.
  • What happens to a Queensland licence before court: For a low range charge (over 0.0 but under 0.10), the licence is generally not suspended immediately until court, unless an earlier drink driving charge is still pending or certain other conditions apply.
  • Work licences: Queensland has a “restricted licence”, commonly called a work licence, under section 87 of the Transport Operations (Road Use Management) Act 1995.
  • Sentencing law: Alongside the disqualification set under the road transport laws, the general sentencing law in Queensland is the Penalties and Sentences Act 1992 (Qld).

What is the minimum disqualification for a first high range offence?

Six months. Josh says the court cannot give less, but can increase it at its discretion. TMR also lists a 6-month minimum for a first offence at 0.15 or more.

What does Josh say about a third high range offence?

He says that where a person has three high range offences within five years, the court must impose a term of imprisonment, although it can be suspended or come with immediate parole.

Does a first offence mean jail?

Josh says the maximum is nine months, but jail is a sentence of last resort and generally is not imposed for a first high range offence unless something significantly aggravates it.

G'day, it's Josh from Boorman Lawyers today in this video I want to talk to you about high range drink driving in Queensland it's also known as drive under the influence of liquor or drugs um and also UIL under the influence of liquor basically this particular category of drink driving offending is anywhere where a an offender has recorded a blood alcohol reading of 0.150 or higher so anything above 0.150 is categorised and classified as a high range drink driving offence

Now when it comes to dealing with the most serious categories of drink driving offences high range drink driving is certainly considered the most serious of offences in Queensland as I've always mentioned in all my videos and material every drink driving matter is dealt with on a case-by-case basis so in one set of circumstances you might just be on the cusp of 0.150 pulled over an RBT in another set of circumstances you might be close to 0.3 extremely intoxicated you might have kids in the car you might be involved in an accident

So there's a whole range of different facts and circumstances objectively speaking which the court will take into consideration when dealing with each matter on a case-by-case basis so when it comes to the penalties involved for high range drink driving in Queensland for a first offence this means where there's no prior offences of a like nature in the last five years then there is a maximum penalty of nine months in prison generally if there's nothing significantly aggravated about a first offensive high range drink driving then a person won't receive time in prison

Certainly jail is always a sentence of last resort in the in the eyes of the court but jail time is at the court's disposal and uh nine months is the maximum for a first offence of high range drink drive in Queensland with a maximum financial penalty of 28 penalty units in relation to the disqualification court is obligated to disqualify an offender's driver's licence for a minimum period of six months they cannot give any less than that the minimum is six months however the period of disqualification can be increased to a much higher period

That's at the court's discretion anywhere up to a lifetime ban or indefinite disqualification that's rarely seen especially for a first time high range drink driver but again that that is at the court's discretion six months being the absolute minimum though and for any high range drink driving offence whether it's first second third or more anything above 0.150 means that you are ineligible you cannot apply for a work licence it's black and white there's no persuading the court it's in law it says anything above 0.150 you cannot apply for a work licence

So the stakes are certainly higher once you you get into the high range drink driving category when it comes to a second offence of high range drink driving within a five year period this means you've got a prior um drink driving matter within the last five years um the maximum penalty is um is 18 months in prison that's a maximum penalty and 60 penalty units for a financial penalty um when it comes to the disqualification period for a second offence namely a high range drink driving offence a second offence within the last five years the minimum disqualification period is 12 months off the road court can't go any lower than that if

But certainly they can go much higher again it's at the courts to discretion to disqualify a person anywhere between one year through to an indefinite disqualification of a person's licence finally for the category of a third offence third high range drink driving offence within a five year period this means that there's two prior drink driving offences in the last five years then the stakes certainly do get a lot higher there is a maximum period of imprisonment of 18 months 60 penalty units

A minimum period of two years um licensed disqualification off the road and again anything above two years can be put in place but two years is the absolute minimum now it is very important to note here with high range drink driving for very high risk offenders repeat offenders and a person who has gone and is on their third high range drink driving events and the two prior drink driving offences within the last five years are both high range that means in total three high range drink driving offences in a five year period then the law says that there is a mandatory sentence of imprisonment which should be for which is forthcoming by the court the court has to sentence a person to a term of imprisonment it doesn't always necessarily mean that it has to be full-time custody in a jail it can be a suspended sentence or a a sentence of jail where you are granted immediate parole on the date of court

But certainly the law is black and white if it's your third high range drink drive offence within a five-year period the court must hand down a period of imprisonment of some sort so it is very very um high risk so those are the issues surrounding high range drink driving in Queensland and certainly the penalties that are forthcoming for first and a second and third um high range offence within Queensland.
